These terms and conditions (these “Terms”) regulate the “Ontop Card - Limited Time Cashback Promotion 1” campaign (this “Campaign”). Through the Campaign, selected Workers that activate their Ontop Card and make their first purchase within the Campaign Period (as defined below) will be offered to receive the Cashback Bonus (as defined below).

1. DEFINITIONS:

1.1 “Campaign Period” means the period between Wednesday, March 20, 2024, 5:00 a.m. (GMT-5) and Friday, March 22, 2024, 11:59 pm (GMT-5).

1.2 “Ontop Card” means a digital prepaid card that Workers can acquire through the Ontop Platform and top up by using their Ontop Worker Wallet balance.

‍

1.3 “Ontop Worker Wallet” or “Worker Wallet” means the electronic or digital wallet account available to Workers from within the Ontop Platform that allows you to receive compensation payments from Clients and make electronic transactions to your own personal account(s) or to third-party accounts.

2. CAMPAIGN  RULES:

2.1 To qualify as participants in this Campaign (“Participant”), you must:

a. receive a communication from Ontop confirming your participation in this Campaign;

‍

b. currently reside in Argentina, Chile, Colombia, Ecuador, El Salvador, Mexico, Parama or Peru;

‍

c. have an active contract on the Ontop Platform;

‍

d. have more than 30 USD in your Ontop Worker Wallet; within the Campaign Period;

‍

e. activate your Ontop Card within the Campaign Period; and

‍

f. make your first purchase with your Ontop Card within the Campaign Period.

‍

2.2 Participants in this Campaign may be eligible to receive 20% cashback, up to a limit of 20 USD, for the first purchase they made with the Ontop Card (“Cashback Bonus”) within the Campaign Period.

2.3 The Cashback Bonus will be credited to the Ontop Worker Wallet on Monday, March 25, 2024. The Cashback Bonus is personal and non-transferable. Please, bear in mind that the Cashback might be considered a gift in your country of tax residency and, therefore, may be subject to tax payments or declarations. You are solely responsible for any federal, state, and local taxes and any other fees, charges, or expenses associated with the Cashback Bonus.

3. GENERAL CONDITIONS OF CAMPAIGN:

3.1 The Campaign will be valid throughout the Campaign Period.

3.2 Ontop reserves the right to (a) cancel, suspend, and/or modify the Campaign and (b) to block a Participant’s account at any time if it is determined that fraud or unlawful action is taking place in order to win the Cashback Bonus.

3.3 Ontop reserves the right to modify the conditions of eligibility for this Campaign and/or to cancel the Campaign, at any time and at its sole discretion.

3.4 Please refer to our B2C General Terms and Conditions and Privacy Policy, as well as the Ontop Card Terms of Service (collectively the “Ontop Platform Terms”), which will govern any matters not explicitly covered by these Terms. Any capitalized terms not defined in these Terms will have the meaning ascribed to them within the Ontop Platform Terms.

3.5 As per Section 16 of the Ontop Card Terms of Service: (i) these Terms will be governed by and construed in accordance with the law of the State of Delaware; and (ii) any dispute in connection with these Terms that cannot be resolved amicably will be resolved by binding arbitration on an individual basis.

3.6 By participating in the Campaign, you acknowledge and agree that the Company may collect, store, and use any personal information you provide in accordance with our Privacy Policy.
