These terms and conditions (these “Terms”) regulate the “Spend and Win” campaign (this “Campaign”). Through the Campaign, independent contractors who are users of the Ontop Platform available at www.getontop.com and have an activate Ontop Card (“Contractors”) will be eligible to receive a bonus to their Ontop Card if they make the most purchases through their Ontop Card during the Campaign Period (as defined below).
1. DEFINITIONS:
1.1 “Campaign Period” means the period between Wednesday, April 13, 12:00 am (GMT-5) and Friday, April 29, 2022, 11:59 pm (GMT-5).
1.2 “Ontop Card” means a digital prepaid card that Contractors can acquire through the Ontop Platform and top up by using their Ontop Global Wallet (as defined below) balance.
1.3 “Ontop Global Wallet” or simply “Wallet” means the e-wallet account which can be activated by and/or accessible to Contractors registered on the Ontop Platform that reflects the available balance of payments from the clients to whom the Contractors provide services, which can be held within the account balance and/or paid out to the independent contractor through a number of different payment methods.
2. CAMPAIGN RULES:
2.1 This Campaign automatically applies to all Contractors who are users of the Wallet and have an active Ontop Card, except for Contractors registered as legal entities and those Contractors who provide services directly to Ontop Holdings Inc. If Contractor participants make a minimum amount of purchases through the Ontop Card during the Campaign Period, they may be eligible to receive a prize in the form of a bonus to their Ontop Card balance (“Card Bonus”).
2.2 In order to be entitled to receive the Card Bonus, a Contractor must have carried out effective purchase transactions through their Ontop Card in the total amount of at least USD 400 or more during the Campaign Period (“Qualified Contractors”).
2.3 At the end of the Campaign Period, the three (3) highest total Ontop Card spenders among Qualified Contractors will be declared as the winners (the “Winning Contractors”). The names of the Winning Contractors will be announced within five (5) business days after the end of the Campaign Period.
2.4 The prizes for the Winning Contractors are as follows (“Prize Pool”):
a. First Place: USD 500
b. Second Place: USD 300
c. Third Place: USD 200
2.4 All Contractors participating in the Campaign hereby consent to having their name published by Ontop in the announcement of the Winning Contractors, whether on the Ontop website, via email, social media or any other form of publication, digital or otherwise, in the event that they are declared as one of the winners of this Campaign.
2.5 The Card Bonuses from the Campaign Prize Pool will be credited to the Winning Contractors’ Ontop Card balance within the month of May 2022.
2.6 The Card Refund is personal and non-transferable. Please bear in mind that the Card Refund might be considered as a gift in your country of tax residency and therefore may be subject to tax payments or declarations.
3. GENERAL CONDITIONS OF CAMPAIGN:
3.1 The Campaign will be valid throughout the Campaign Period.
3.2 Ontop reserves the right to (a) cancel the Campaign and (b) to block a Contractor’s account at any time if it is determined that fraud or unlawful action is taking place in order to obtain the benefit of the Card Bonus.
3.3 Ontop reserves the right to modify the conditions of eligibility for this Campaign and/or to cancel the Campaign, at any time and at its sole discretion.
3.4 Ontop reserves the right, at its sole discretion, to modify, change or update these Terms at any time. Modifications will be communicated by Ontop and will take effect immediately from the time of publication.
3.5 Please refer to our Ontop Platform Terms of Service and Privacy Policy (collectively the “Ontop Platform Terms”), which shall govern any matters not explicitly covered by these Terms. All participants in the Campaign will need to have explicitly accepted our Ontop Platform terms to be eligible for the Card Bonus. Any capitalized terms in these Terms that are not defined herein shall have the meaning ascribed to them within the Ontop Platform Terms.
