Flight Frenzy - Terms and Conditions

These terms and conditions (these “Terms”) regulate the “January Flight Frenzy” (this “Campaign”). During the Campaign, eligible Ontop Card holders subscribed to the Wanderlust plan (“Wanderlust Subscribers”) will receive an elevated 7% cashback on qualifying flight purchases. Additionally, new subscribers who join the Wanderlust plan during the Campaign Period will also be able to enjoy this elevated cashback benefit.

1. DEFINITIONS:

1.1 “Campaign Period” means the period between Friday, January 31, 2025, 00:00 am (GMT-5) and Friday, January 31, 2025, 12:00 pm (GMT-5).

‍1.2 “Ontop Card” refers to the prepaid card (physical or digital) that users can acquire through the Ontop Platform and top up using their Ontop Global Wallet or Worker Wallet balance.

1.3 “Wanderlust Plan” is a subscription plan offered by Ontop that provides subscribers with enhanced benefits, including higher cashback rates on certain purchases.

‍

1.4 “Cashback” refers to the bonus amount credited back to the Participant’s Ontop Card based on eligible purchases made during the Campaign Period.

‍

1.5 “Participant(s)” means individuals who meet the eligibility criteria set forth in Section 2 and take part in this Campaign.

2. CAMPAIGN  RULES:

2.1 Eligibility: To qualify for this Campaign and receive the 7% flight cashback, you must:

- Be an active Wanderlust Subscriber prior to or during the Campaign Period; or

- Subscribe to the Wanderlust Plan during the Campaign Period;

- Make an eligible flight purchase using your Ontop Card within the Campaign Period (see Section 2.2).

‍2.2 7% Flight Cashback Offer: 

- Participants will receive 7% cashback on qualifying flight purchases made with the Ontop Card during the Campaign Period.

- This elevated cashback rate applies only to Wanderlust Subscribers.

- The standard cashback or other promotions do not apply to flight purchases during the Campaign Period.

2.3 Cashback Calculation and Limits:

- The 7% cashback is calculated based on the total amount of eligible flight purchases made with the Ontop Card during the Campaign Period.

- Ontop reserves the right to set a maximum total cashback limit of $100 USD per Participant throughout the Campaign Period.

2.4 Cashback Crediting: The cashback amount will be credited to the Participant’s Ontop Card within thirty (30) days following the end of the Campaign Period. The cashback is personal and non-transferable and cannot be exchanged for cash or other forms of credit.

2.5 Exclusions:

- Only flight purchases (e.g., airline tickets) made within the Campaign Period are eligible for the 7% cashback.

- Purchases or transactions outside the specified dates and times of the Campaign Period are not eligible.

- This Campaign cannot be combined with other promotions, discounts, or subscription plans offered by Ontop, unless explicitly stated.

3. GENERAL CONDITIONS OF CAMPAIGN:

3.1 Validity. The Campaign is valid only during the Campaign Period.

3.2 Fraudulent Activity: Ontop reserves the right to suspend or terminate the Participant’s access to the Campaign or their Ontop account if any fraudulent or unlawful activity is detected. Any attempt to manipulate or abuse the Campaign will result in disqualification.

3.3 Modification and Termination. Ontop reserves the right, at its sole discretion, to modify or cancel this Campaign at any time. Changes will be communicated promptly and will take effect immediately upon publication. If material changes are made, Participants will be notified through appropriate channels, such as in-app notifications or email.

3.4 Limitation of Liability. By participating in the Campaign, you agree to release Ontop, its affiliates, and representatives from any claims or liability arising from your participation. Ontop is not responsible for any technical issues, system failures, or other problems that may result in lost or incomplete transactions.

‍3.5  Governing Documents. Please refer to our Client General Terms and Conditions and Worker General Terms and Conditions, Privacy Policy, as well as the Ontop Card Terms of Service (collectively the “Ontop Platform Terms”), which govern any matters not explicitly covered by these Terms. Any capitalized terms not defined in these Terms will have the meaning ascribed to them in the Ontop Platform Terms.

3.6 Governing Law and Dispute Resolution. These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising under or related to these Terms will be resolved through binding arbitration on an individual basis, in accordance with the arbitration provisions set forth in the Ontop Card Terms of Service.

3.7 Tax Implications. Cashback rewards may be considered taxable income in your country of residence. Participants are solely responsible for any tax obligations arising from the cashback rewards.

3.8 Data Privacy. By participating in the Campaign, you consent to the collection and use of your personal information as described in the Privacy Policy. Ontop may share necessary details with third-party vendors or service providers solely for the administration of this Campaign.
