Valentines Giveaway - Terms and Conditions

Campaign Begins: Monday, January 20, 2025, 12:00 am (GMT-5) to Monday, January 20, 2025, 11:59 pm (GMT-5)

Campaign Ends: Thursday, February 13, 2025, 12:00 am (GMT-5) to Thursday, February 13, 2025, 11:59 pm (GMT-5)

These terms and conditions (these “Terms”) govern the Valentines Giveaway (this “Campaign”). Throughout the Campaign, eligible Ontop Card holders who meet the stated requirements will have a chance to enter a raffle for $500 USD (the “Prize”).

1. DEFINITIONS:

1.1 “Campaign Period” means the period between Monday, January 20, 2025, 12:00 am (GMT-5) and Thursday, February 13, 2025, 11:59 pm (GMT-5).

‍1.2 “Frenzy Days” refers to the special promotional dates within the Campaign Period:

- January 25, 2025

- February 1, 2025

- February 8, 2025

Purchases made on these dates will yield additional entries to the raffle, as described in Section 2.4.

‍1.3 “Ontop Card” means a physical or digital prepaid card that Contractors or Workers can acquire through the Ontop Platform, which can be topped up using their Ontop Global Wallet or Worker Wallet balance.

‍

1.4 “Ontop Platform” or the “Platform” means the software as a service (SaaS) system accessible via login through the Ontop Website and/or mobile applications, enabling Clients to contract, onboard, pay, and manage relationships with independent contractors.

‍

1.5 “Wanderlust Subscriber” means a user of the Ontop Card who is subscribed to the Wanderlust plan, which provides enhanced benefits such as additional raffle entries (as outlined in Section 2.3).

‍

1.6 “Participant(s)” means individuals who hold an Ontop Card, fulfill the Eligibility criteria (see Section 2.1), and participate in the Campaign according to these Terms.

‍

1.7 “Prize” means the $500 USD amount to be awarded in the raffle, credited to the winner’s Ontop Card (or any alternative method as determined by Ontop).

2. CAMPAIGN  RULES:

2.1 Eligibility: To qualify as a Participant in this Campaign, you must:

- Hold an active Ontop Card with sufficient balance to make purchases.

- Reside in one of the following countries: Argentina, Bolivia, Chile, Colombia, Guatemala, Mexico, Panama, Peru, or Uruguay.

- Be at least eighteen (18) years of age, or the age of majority in your jurisdiction of residence, whichever is older.

2.2 Minimum Spending Requirement: 

- Make at least three (3) purchases using your Ontop Card,

- For a combined total of $100 USD or more,

- During the Campaign Period (January 20, 2025, 12:00 am (GMT-5) to February 13, 2025, 11:59 pm (GMT-5)).

Participants who meet these requirements will earn one (1) raffle entry.

2.3 Additional Entries for Wanderlust Subscribers: If you are a Wanderlust Subscriber and meet the minimum spending requirement in Section 2.2, you will receive four (4) raffle entries (instead of one).

2.4 Frenzy Days Bonus Entries:

- Purchases made on Frenzy Days (January 25, February 1, and February 8, 2025) will grant additional entries for each qualifying transaction.

- The number of extra entries per Frenzy Day purchase will be announced in promotional materials.

- These bonus entries apply on top of the baseline (1) or Wanderlust-based (4) entries, as applicable.

2.5 Raffle and Prize:

- The Prize is $500 USD, credited to the Ontop Card of the selected winner.

- The winner will be chosen through a random draw on February 14, 2025.

- The selected winner will be notified via email or in-app communication. If the winner cannot be contacted or is deemed ineligible, Ontop may select an alternate winner.

2.6 Exclusions::

- Transactions that occur before or after the Campaign Period will not count toward the spending requirement.

- Fraudulent or suspicious transactions, as determined by Ontop’s sole discretion, will be disqualified.

- Employees of Ontop, affiliates, agents, or subsidiaries, as well as their immediate family members, are not eligible to participate.

3. GENERAL CONDITIONS OF CAMPAIGN:

3.1 Validity. The Campaign is valid only during the Campaign Period

3.2 Fraudulent Activity. Ontop reserves the right to suspend or terminate a Participant’s access to the Campaign and/or their Ontop account if any fraudulent or unlawful activity is detected. Any attempt to manipulate or abuse the Campaign will result in disqualification.

3.3 Modification and Termination. Ontop reserves the right to modify the eligibility conditions, alter the rules, or cancel the Campaign at any time, at its sole discretion. Any changes will be communicated promptly and will take effect immediately from the time of publication.

3.4 Limitation of Liability. By participating in the Campaign, you agree to release Ontop, its affiliates, and representatives from any claims or liability arising from or in connection with your participation. Ontop is not responsible for any technical issues, system failures, or other problems that may result in lost, incomplete, or otherwise unrecorded transactions.

‍3.5  Governing Documents. Please refer to our Client General Terms and Conditions and Worker General Terms and Conditions and Privacy Policy, as well as the Ontop Card Terms of Service (collectively the “Ontop Platform Terms”), which govern any matters not explicitly covered by these Terms. Any capitalized terms not defined in these Terms will have the meanings ascribed to them in the Ontop Platform Terms.

3.6 Governing Law and Dispute Resolution. These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from or in connection with these Terms will be resolved through binding arbitration on an individual basis, as outlined in the Ontop Card Terms of Service.

3.7 Tax Implications. Any rewards or prizes won under this Campaign may be considered taxable income in your country of residence. Participants are solely responsible for any tax obligations arising from their winnings.

3.8 Data Privacy. By participating in the Campaign, you consent to the collection and use of your personal information as described in our Privacy Policy.
