These Ontop Future Fund Terms and Conditions (“Terms”) govern the optional service through which eligible users (“Workers” or “You”) may temporarily provide funds to Ontop Holdings Inc. ("Ontop", "we", "us") to obtain variable reward credits (“Rewards”). By activating or using the Ontop Future Fund Service (“Future Fund Service” or the “Service”), you confirm that you have read, understood, and accepted these Terms. These Terms form a binding agreement between you and Ontop Holdings Inc. and supplement the Ontop Platform General Terms and Conditions for Workers, the Ontop Worker Wallet Terms of Service, the Ontop Privacy Policy, and all other applicable disclaimers and platform rules.
The Future Fund Service is a voluntary loan arrangement through which Workers may temporarily loan funds to Ontop in exchange for Rewards.
By using the Service, you understand and agree that:
You may voluntarily allocate funds from your Worker Wallet to your Future Fund balance (“Pocket”).
You may request a withdrawal to your Worker Wallet at any time. Ontop will use commercially reasonable efforts to return funds within one (1) business day.
During market stress, operational incidents, or regulatory events, withdrawal timelines may be extended as reasonably necessary.
From time to time, Ontop may grant promotional Rewards on outstanding Pocket balances.
Ontop may establish minimum and maximum funding limits per transaction or in aggregate. Ontop may modify these limits at its discretion based on operational, regulatory, or risk considerations.
Ontop may also establish program-level caps and may decline additional funding at any time.
Ontop may terminate, suspend, or modify the Service at its sole discretion.
This Service is not an investment product, savings product, brokerage service, advisory service, or securities-related service.
Ontop:
You are solely responsible for determining whether participation in the Future Fund Service is appropriate for your circumstances.
Ontop may allocate Pocket funds to third-party borrowers, including OpenTrade, under separate agreements. Such arrangements may be secured in favor of third-party trustees.
This disclosure does not create any rights for you against third-party borrowers.
Workers do not have the right to:
Ontop does not guarantee any fixed or minimum Reward rate. Rewards may fluctuate based on market conditions, third-party arrangements, and other factors outside of Ontop’s control.
Ontop may receive fees, rebates, or other consideration from third parties in connection with Pocket allocations. Such amounts are retained by Ontop and are not shared with Workers.
To use the Service, you must:
Ontop may refuse or terminate access at its discretion.
Rewards depend on Ontop’s performance and third-party arrangements. Ontop does not guarantee any minimum return.
The Pocket represents an unsecured loan to Ontop. If Ontop becomes insolvent, you may lose some or all of your balance.
Withdrawals may experience delays due to market stress, operational disruptions, or third-party issues.
Rewards may vary, fluctuate, or be discontinued entirely.
Ontop may suspend or terminate the Service at its discretion. Legal or regulatory changes may also require modification or discontinuation of the Service.
The Future Fund Service is designated as a Beta Test Service and is provided “AS IS” with no express or implied warranty. Features and service parameters may change prior to general release. Continued access is not guaranteed.
Future Fund balances:
Participation is voluntary and at your sole discretion.
Ontop may suspend, terminate, or limit access to the Service for reasons including breach, suspected fraud, regulatory requirements, or risk management concerns.
If the Service is discontinued, Ontop will return your Pocket principal and any accrued Rewards to your Worker Wallet.
During suspension or termination, Ontop will prioritize the return of principal first, followed by accrued Rewards.
To the maximum extent permitted by law:
Aggregate liability is capped at US $100.
You are solely responsible for understanding and fulfilling all tax obligations arising from any Rewards.
Ontop does not provide tax advice and does not withhold taxes unless required by law.
You should consult your own tax advisor.
These Terms are governed by the same governing law specified in the Worker T&Cs.
Any dispute will be resolved according to the dispute resolution mechanisms set forth in the Worker T&Cs.
Ontop may modify these Terms from time to time.
Material changes will be communicated in advance whenever feasible.
Continued use of the Service after the effective date constitutes acceptance of updated Terms.
For any material adverse change, you may withdraw your entire Pocket balance fee-free before the effective date.
