These terms and conditions ("Terms") govern the "Card Activation First Purchase April" campaign (the "Campaign"). Through the Campaign, eligible independent contractors who utilize the Ontop Platform ("Contractors"), available at www.getontop.com, will be eligible to receive a USD 7 (seven United State dollars) bonus as a reward. To qualify, Contractors must activate their Ontop Card and complete a minimum purchase of USD 15 (fifteen United States dollars) within the designated Campaign Period (as defined below).
1. DEFINITIONS:
1.1 "Campaign Period" means the period between Tuesday, March 28th, 2023, 00:00 (GMT-5) and Sunday, April 30th, 2023, 11:59 pm (GMT-5).
1.2 "Ontop Card" means a digital prepaid card that Contractors can acquire through the Ontop Platform and top up by using their Ontop Global Wallet (as defined below) balance.
1.3 "Ontop Global Wallet" or simply "Wallet" means the e-wallet account which can be activated by and/or accessible to Contractors registered on the Ontop Platform that reflects the available balance of payments from the clients to whom the Contractors provide services, which can be held within the account balance and/or paid out to the independent contractor through different payment methods.
2. CAMPAIGN RULES:
2.1 Contractors who activate their Ontop Card and make their first purchase within the Campaign Period will be eligible to participate in this Campaign, except for those Contractors who provide services directly to Ontop Holdings Inc. or its affiliates ("Ontop Group"). Contractors may be eligible to receive USD 7 (seven United States dollars) credit bonus to their Ontop Card balance ("Card Bonus") if they activate the Ontop Card and make a minimum purchase of USD 15 (fifteen United States dollars) through the Ontop Card during the Campaign Period.
2.2 To be entitled to receive the Card Bonus, Contractors must have (i) activated the Ontop Card and (ii) carried out an effective purchase transaction during the Campaign Period. The Card Bonus will be credited to the Contractor's Ontop Card balance within thirty (30) days of the end of the Campaign Period.
2.3 The Card Bonus is a once-off benefit applicable only to the first purchase with the Ontop Card amounting to USD 15 (fifteen United States dollars) or greater.
2.4 The Card Bonus is personal and non-transferable. Please, bear in mind that the Card Bonus might be considered a gift in your country of tax residency and, therefore, may be subject to tax payments or declarations. Contractors are solely responsible for any federal, state, and local taxes and any other fees, charges, or expenses associated with the Card Bonus.
3. GENERAL CONDITIONS OF THE CAMPAIGN:
3.1 The Campaign will be valid throughout the Campaign Period.
3.2 Ontop reserves the right to (a) cancel the Campaign and (b) to block a Contractor's account at any time if it is determined that fraud or unlawful action is taking place in order to obtain the benefit of the Card Bonus.
3.3 Ontop reserves the right to modify the eligibility conditions for this Campaign and/or cancel the Campaign at any time and at its sole discretion.
3.4 Ontop reserves the right, at its sole discretion, to modify, change or update these Terms at any time. Modifications will be communicated by Ontop and will take effect immediately from the time of publication.
3.5 Please refer to our Ontop Platform Terms of Service, Ontop Card Terms of Service, and Privacy Policy (collectively the "Ontop Platform Terms"), which shall govern any matters not explicitly covered by these Terms. All participants in the Campaign will need to have explicitly accepted our Ontop Platform terms to be eligible for the Card Bonus. Any capitalized terms in these Terms that are not defined herein shall have the meaning ascribed to them within the Ontop Platform Terms.
3.6 As per Section 16 of the Ontop Card Terms of Service: (i) these Terms shall be governed by and construed in accordance with the law of the State of Delaware; and (ii) any dispute in connection with these Terms that cannot be resolved amicably shall be resolved by binding arbitration on an individual basis.
3.7 By participating in the Campaign, you acknowledge and agree that Ontop may collect, store, and use any personal information you provide in accordance with our Privacy Policy.
