“One Ontop Day”

These terms and conditions (these “Terms”) govern the “One Ontop Day” campaign (the “Campaign”). Although the Campaign spans the entire period mentioned above, One Ontop Day is conceived as a 24-hour event within this timeline. During the Campaign, eligible Participants (as defined below) can earn special rewards and cashback offers by making qualifying transactions with their Ontop Card.

1. DEFINITIONS:

1.1 “Campaign Period” refers to the timeframe between February 1, 2025, 00:00 am (GMT-5) and February 28, 2025, 12:00 pm (GMT-5), within which the 24-hour One Ontop Day event(s) will be hosted.

‍1.2 “Ontop Card” means a prepaid card (physical or digital) that users can acquire through the Ontop Platform, which can be topped up using their Ontop Global Wallet or Worker Wallet balance.

1.3 “Wanderlust Subscription” is a premium plan offered by Ontop that provides subscribers with enhanced benefits, including higher cashback rates on eligible purchases.

‍

1.4 “Cashback” refers to the bonus amount credited back to the Participant’s Ontop Card based on eligible purchases made during the Campaign Period.

‍

1.5 “Participant(s)” means individuals who meet the eligibility criteria set forth in Section 2 and take part in this Campaign.

2. CAMPAIGN  RULES:

2.1 Eligibility: To qualify for the rewards under this Campaign, you must:

- Be an active Ontop user with a valid account.

- Make an eligible transaction within the Campaign Period, as detailed in Section 2.2.

- Meet any specific conditions associated with each reward category.

‍2.2 One Ontop Day Rewards:

1. First Ontop Card Purchase: 

- Reward: 5% cashback on your first-ever Ontop Card transaction.

- Condition: The transaction must be made within the Campaign Period.

- Limit: Ontop reserves the right to cap cashback rewards at $10 USD per user.

2. Wanderlust Subscription Activation: 

- Reward: Get $4 back on all purchases made during the Campaign Period.

- Condition: You must activate a new Wanderlust Subscription on the same day to qualify.

3. Wallet Transfers: 

- Reward: 50% discount in transfer fees on all Wallet transfers during the event.

- Condition: Third-Party Transfers must be completed within the Campaign Period.

- Limit: Ontop reserves the right to limit wallet transfers to a maximum of 3 per user.

4. Ontop Card Usage: 

- Reward for Non-Wanderlust Users: 2% cashback on all purchases made using the Ontop Card.

- Reward for Wanderlust Subscribers: An extra 2% cashback on all general purchases (which normally have a 2% cashback) made using the Ontop Card, effectively doubling the baseline rate.

- Condition: The purchase must be completed within the Campaign Period.

- Limit: Ontop reserves the right to cap cashback rewards at $50 USD per user.

2.3 Cashback Calculation and Limits:

- Cashback is calculated based on the total amount of eligible transactions made during the Campaign Period.

- Ontop reserves the right to impose an overall maximum cashback cap of $200 USD per user across all categories.

2.4 Cashback Crediting: The cashback amount will be credited to the Participant’s Ontop Card within thirty (30) days following the end of the Campaign Period. All cashback is personal, non-transferable, and cannot be exchanged for cash or other forms of credit.

2.5 Exclusions:

- Transactions made outside the specified Campaign Period are not eligible for rewards.

- This Campaign cannot be combined with other Ontop promotions unless explicitly stated.

- Any fraudulent, incomplete, or suspicious transactions may be disqualified at Ontop’s sole discretion.

3. GENERAL CONDITIONS OF CAMPAIGN:

3.1 Validity. This Campaign is valid only during the Campaign Period and applies exclusively to qualifying transactions completed within that timeframe.

3.2 Fraudulent Activity: Ontop reserves the right to suspend or terminate the Participant’s access to the Campaign if any fraudulent or unlawful activity is detected. Any attempt to manipulate or abuse the Campaign will result in disqualification.

3.3 Modification and Termination. Ontop may, at its sole discretion, modify or cancel this Campaign at any time. Any changes will be communicated promptly through appropriate channels, such as in-app notifications or email.

3.4 Limitation of Liability. By participating in the Campaign, Participants release Ontop, its affiliates, and representatives from any claims or liability arising out of or in connection with their participation. Ontop is not responsible for technical failures, system errors, or other issues that may prevent or hinder participation.

‍3.5  Governing Documents. Please refer to our Client General Terms and Conditions and Worker General Terms and Conditions, Privacy Policy, as well as the Ontop Card Terms of Service (collectively the “Ontop Platform Terms”) for any matters not explicitly covered by these Terms. Any capitalized terms not defined in these Terms shall have the meaning ascribed to them in the Ontop Platform Terms.

3.6 Governing Law and Dispute Resolution. These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms will be resolved through binding arbitration on an individual basis, as outlined in the Ontop Card Terms of Service.

3.7 Tax Implications. Cashback rewards may be considered taxable income depending on your country of residence. Participants are solely responsible for any tax obligations related to receiving these rewards.

3.8 Data Privacy. By participating in the Campaign, you consent to the collection, storage, and use of your personal information as described in our Privacy Policy. Ontop may share necessary data with third-party service providers solely for the purpose of administering this Campaign.
