These terms and conditions (these “Terms”) regulate the “Ontop Activation Adventure Digital” campaign (this “Campaign”). Through the Campaign, during the month of August 2024, Ontop Card holders will be able to receive a $5 USD reward on purchases made in specific categories during certain weeks.

1. DEFINITIONS:

1.1 “Campaign Period” means the period between Monday, August 5, 2024, 1:00 pm (GMT-5) and Saturday, August 31, 2024, 4:00 am (GMT-5).

1.2 “Ontop Card” means a digital prepaid card that Workers can acquire through the Ontop Platform and top up by using their Ontop Worker Wallet balance.

‍

1.3 “Ontop Worker Wallet” or “Worker Wallet” means the electronic or digital wallet account available to Workers from within the Ontop Platform that allows you to receive compensation payments from Clients and make electronic transactions to your own personal account(s) or to third-party accounts.

2. CAMPAIGN  RULES:

2.1 To qualify as a participant in this Campaign (“Participant”), you must:

a. Currently reside in Bolivia, Costa Rica, Chile, the Dominican Republic, El Salvador, Ecuador, Guatemala, Honduras, Panama, Paraguay, Puerto Rico or Uruguay;

‍

b. Own an Ontop Card; and

‍

c. Make a purchase with your Ontop Card in the specified categories during the dates mentioned below:

- Week 1 (August 5th to August 11th): E-commerce (Amazon, Ebay, Alibaba, Temu, etc.);

- Week 2 (August 12th to August 18th): Brand Websites (Adidas, Nike, Linio, Falabella, etc.);

- Week 3 (August 19th to August 25th): Food Delivery (Rappi, DiDi Eats, Uber Eats, etc.); and

- Week 4 (August 26th to August 31st):Fashion Retailers (Zara, H&M, ASOS, Shein, etc.).

2.2 Participants in this Campaign may be eligible to receive (i) a $5 USD Ontop Card during the Campaign period for the purposes of making their first purchase with the Ontop Card (the “Wallet Bonus”); or (ii) an Ontop Card bonus in the amount of $5 USD (the “Card Bonus”) for making a single purchase during each of the mentioned weeks, up to a maximum of $5 USD.

2.3 The Card Bonus will be credited to the Ontop Card within thirty (30) days of the end of the Campaign Period. The Wallet Bonus and Card Bonus are personal and non-transferable. Please, bear in mind that the Wallet Bonus and Card Bonus might be considered a gift in your country of tax residency and, therefore, may be subject to tax payments or declarations. You are solely responsible for any federal, state, and local taxes and any other fees, charges, or expenses associated with the Wallet Bonus and Card Bonus.

2.4 This Campaign can not be combined with other campaigns, promotions, or discounts.

3. GENERAL CONDITIONS OF CAMPAIGN:

3.1 The Campaign will be valid throughout the Campaign Period.

3.2 Ontop reserves the right to (a) cancel, suspend, and/or modify the Campaign and (b) to block a Participant’s account at any time if it is determined that fraud or unlawful action is taking place in order to win the Prize.

3.3 Ontop reserves the right to modify the conditions of eligibility for this Campaign and/or to cancel the Campaign at any time and at its sole discretion.

3.4 Please refer to our B2C General Terms and Conditions and Privacy Policy, as well as the Ontop Card Terms of Service (collectively the “Ontop Platform Terms”), which will govern any matters not explicitly covered by these Terms. Any capitalized terms not defined in these Terms will have the meaning ascribed to them within the Ontop Platform Terms.

3.5 As per Section 16 of the Ontop Card Terms of Service: (i) these Terms will be governed by and construed in accordance with the law of the State of Delaware; and (ii) any dispute in connection with these Terms that cannot be resolved amicably will be resolved by binding arbitration on an individual basis.

3.6 By participating in the Campaign, you acknowledge and agree that Ontop may collect, store, and use any personal information you provide in accordance with our Privacy Policy.

3.7 Ontop is not responsible for unauthorized purchases made or fraud committed with your Ontop Card.

3.8 This Campaign is solely organized by Ontop. The brands mentioned in these Terms, including Amazon, Ebay, Alibaba, Temu, Adidas, Nike, Linio, Falabella, Rappi, DiDi Eats, Uber Eats, Zara, H&M, ASOS, Shein, and others, are not involved in this campaign. The logos and mentioned brand names belong to their respective owners and are included only for the purpose of identifying the vendors relevant to the campaign. Ontop holds no relationship with these brands.
