These Terms and Conditions (these “Terms” or “T&Cs”) govern Ontop Challenge, our loyalty rewards program (“Ontop Challenge” or the “Program”).

‍

🧐 PLEASE READ THESE TERMS CAREFULLY BEFORE ADHERING TO THE PROGRAM. THESE TERMS ARE NON-NEGOTIABLE.

1. Ontop Challenge Overview

Ontop Challenge is a gamified onboarding model where we want our users to earn points that convert into dollars by performing specific actions within the application.

2. Who or What is That? 🙋

2.1 “Beta Program” means the beta test run for Ontop Challenge, which will run from Wednesday, September 4, 2024, 1:00 pm (GMT-5) to Monday, September 30, 2024, 10:00 am (GMT-5) (the “Beta Program Period”).

2.2 “Ontop Challenge” or the “Program” is the Ontop loyalty program that grants rewards to Workers for their use of the Ontop Worker Wallet and Ontop Card.

‍

2.3 “Participant(s)” or “you” are individuals who participate in the Program to receive exclusive benefits related to your use of the Ontop Card and Ontop Worker Wallet.

‍

2.4 “Third-Party Account” means any bank account registered with and managed by an individual other than yourself.

‍

Any capitalized terms that are not defined under these Terms will have the meanings ascribed to them in the B2C General Terms and Conditions and Ontop Worker Wallet Terms of Service.

3. Participating in Ontop Challenge 🎟️

3.1 To qualify as a Participant in the Beta Program, you must:

‍

a. receive a communication from Ontop with an offer to participate in this Program; and

‍

b. have an active contract on the Ontop Platform.

‍

4. Ontop Challenge Rewards 🏆

4.1 Participants will qualify and be eligible to receive $10 (“Cash Rewards”) in their Ontop Card by completing all the steps outlined below in Section 4.1 (a) to (c) during the Beta Program, as follows:

‍

a. Transfer funds from the Ontop Wallet to a Third-Party Account Account;

‍

b. Activate the top-up the Ontop Card; and

‍

c. Make at least one purchase with the Ontop Card.

‍

‍4.2 Participants may be eligible for an additional $5 cash bonus if they subscribe to the Wanderlust plan after completing all the steps outlined in Section 4.1(a) to (c).

‍

‍4.3 The Cash Reward will be credited to the Ontop Worker Wallet within thirty (30) days of the end of the Beta Program Period. The Cash Reward is personal and non-transferable. Please bear in mind that the Cash Reward might be considered a gift in your country of tax residency and, therefore, may be subject to tax payments or declarations. You are solely responsible for any federal, state, and local taxes and any other fees, charges, or expenses associated with the Cash Reward.

5. General Terms and Conditions

5.1 The Beta Program will be valid throughout the Beta Program Period.

5.2 We reserve the right to (a) cancel, suspend, and/or modify the Beta Program and (b) block a Participant’s account at any time if it is determined that fraud or unlawful action is taking place.

‍

5.3 We reserve the right to modify the conditions of eligibility for this Beta Program and/or to discontinue the Program at any time and at our sole discretion.

‍

5.4 Please refer to our B2C General Terms and Conditions, Ontop Worker Wallet Terms of Service, and Privacy Policy (collectively the “Ontop Platform Terms”), which will govern any matters not explicitly covered by these Terms.

5.5 As per Section 16 of the Ontop Wallet Terms of Service: (i) these Terms will be governed by and construed in accordance with the law of the State of Delaware; and (ii) any dispute in connection with these Terms that cannot be resolved amicably will be resolved by binding arbitration on an individual basis.

5.6 By participating in the Beta Program, you acknowledge and agree that we may collect, store, and use any personal information you provide in accordance with our Privacy Policy.

5.7 We reserve the right to modify the terms and conditions of this Program at any time and for any reason.
