Ontop Legal Terms

Promotion Dates: August 4, 13, 15, 26 and 31, 2026

Promotion Window (each date): 5:00 pm – 6:00 pm (Colombia Time, GMT-5)

These Terms and Conditions (the "Terms") govern the Hora Loca Random campaign (the "Campaign"). Eligible Ontop users may participate in a promotional offer to receive 2% cashback (up to a USD 10 cap) by completing an eligible purchase with the Ontop Card during the Promotion Window on any of the Promotion Dates.

1. DEFINITIONS:

1.1 "Promotion Dates"

Means the following days on which the Campaign is active: Tuesday, August 4, 2026; Thursday, August 13, 2026; Saturday, August 15, 2026; Wednesday, August 26, 2026; and Monday, August 31, 2026.

1.2 "Promotion Window"

Means the daily period between 5:00 pm and 6:00 pm (Colombia Time, GMT-5) on each of the Promotion Dates.

1.3 "Ontop Card"

Means the prepaid card (physical or digital) issued by Ontop and linked to the user's Ontop Wallet.

1.4 "Eligible Transaction"

Means the first transaction made using the Ontop Card that is:

• Successfully completed within a Promotion Window on a Promotion Date
• Settled (not pending, reversed, or refunded)

1.5 "Reserve"

Means the applicable Ontop product, subscription, benefit, or feature identified by Ontop as "Reserve," subject to availability, eligibility, and applicable product terms.

1.6 "Reserve Cashback"

Means the regular cashback that Reserve users may earn at eligible cashback merchants under the applicable Reserve product terms, independently of this Campaign.

1.7 "Participant(s)"

Means Ontop users who:

• Receive the campaign communication (Push Notification and/or In-App Pop-up)
• Make one Eligible Transaction during a Promotion Window
• Comply with these Terms

1.8 "Reward"

Means a total amount of 2% the value of the first eligible transaction (up to USD 10) made during a Promotion Window, which will be awarded to all Participants who comply with the requirements.

2. CAMPAIGN RULES:

• To win in the Campaign, users must:
  • Have an active Ontop account
  • Have an active Ontop Card
  • Complete an Eligible Transaction during a Promotion Window
  • Comply with Ontop's General Terms and Conditions

This promotion is available for both Reserve and Non-Reserve users:

• Reserve users: the 2% promotional cashback is stackable with their regular Reserve Cashback when shopping at eligible cashback merchants.
• Non-Reserve users: may participate in the promotion under the same conditions. Reserve members earn cashback every day, not only during special promotions.

3. ENTRY MECHANICS:

The promotion applies only to eligible Ontop users who receive the campaign communication (Push Notification and/or In-App Pop-up). To participate, users must complete their first purchase with the Ontop Card within the Promotion Window (5:00 pm – 6:00 pm, Colombia Time) on a Promotion Date.

Cashback will be calculated as follows:

• Participants will receive 2% cashback on their first eligible transaction made within a Promotion Window
• Cashback is capped at USD 10 per Promotion Date
• Only the settled transaction amount will be considered for cashback calculation
• The benefit applies to the first eligible transaction only within each Promotion Window
• For Reserve users, this 2% is granted in addition to any applicable Reserve Cashback earned at eligible merchants

Transactions that do not meet the eligibility criteria or occur outside a Promotion Window will not qualify for the promotion.

4. WINNER SELECTION AND PRIZE DISTRIBUTION:

• Eligible participants will receive their 2% cashback (up to a USD 10 cap) after completing their first qualifying transaction within a Promotion Window.
• Cashback will be credited to the participant's Ontop Wallet on the next business day following the applicable Promotion Date.
• Ontop reserves the right to verify the eligibility of each transaction and participant before issuing the cashback.
• The cashback reward is non-transferable and may not be exchanged for other benefits.

5. ELIGIBILITY AND VALIDATION:

Only transactions that meet the following criteria will be considered:

• Successfully completed within a Promotion Window on a Promotion Date
• Settled and not pending
• Not reversed, refunded, or disputed
• The first eligible transaction made by the Participant within the applicable Promotion Window

Entries will be calculated after transaction validation.

6. RESTRICTIONS:

The following will not be considered:

• Transactions made before or after a Promotion Window
• Transactions made on dates other than the Promotion Dates
• Second or subsequent transactions within a Promotion Window
• Pending, reversed, refunded, or canceled transactions
• Transactions identified as fraudulent or abusive
• Participants who did not receive the campaign communication (Push Notification and/or In-App Pop-up)

Ontop reserves the right to disqualify any Participant suspected of attempting to manipulate or abuse the Campaign.

7. MODIFICATION AND TERMINATION:

Ontop reserves the right to:

• Modify or suspend the Campaign
• Adjust validation criteria

Any modifications will not affect transactions already completed in compliance with these Terms.

8. PERSONAL DATA:

Participation in this Campaign implies consent for Ontop to process personal data strictly for Campaign administration purposes, in accordance with Ontop's Privacy Policy.

9. ACCEPTANCE OF TERMS:

Participation in this Campaign constitutes full acceptance of these Terms and Ontop's General Terms and Conditions.

10. GENERAL CONDITIONS OF CAMPAIGN:

10.1 Validity

The Campaign will be valid only during the Promotion Windows on the Promotion Dates defined in these Terms.

10.2 Fraudulent Activity

Ontop reserves the right to cancel, suspend, or modify the Campaign and block a Participant's account if fraud or unlawful action is detected in order to gain additional cashback.

10.3 Eligibility

Ontop reserves the right to modify eligibility conditions or cancel the Campaign at any time at its sole discretion.

10.4 Modification and Termination

Ontop reserves the right to modify, change, or update these Terms at any time. Modifications will take effect immediately upon publication.

10.5 Limitation of Liability

By participating in the Campaign, Participants agree to release Ontop, its affiliates, and representatives from any claims arising from participation in the Campaign. Ontop is not responsible for technical failures or system issues that may result in incomplete transactions.

10.6 Governing Documents

Please refer to the Ontop Platform Terms, including the Client General Terms and Conditions, Worker General Terms and Conditions, Privacy Policy, Ontop Card Terms of Service, and Reserve terms, which govern matters not covered in these Terms.

10.7 Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware. Any disputes will be resolved through binding arbitration as outlined in the Ontop Card Terms of Service.

10.8 Tax Implications

Participants are solely responsible for any taxes or expenses associated with the cashback rewards.

10.9 Data Privacy

By participating in the Campaign, you consent to the collection and use of personal information as described in Ontop's Privacy Policy.
